HEALTHILY “GEN AI” MEDICAL CHATBOT TESTING TERMS AND CONDITION

The “Gen AI” Medical ChatBot testing (the “Test”) is organised by Healthily Ltd, a company incorporated in England and Wales, with a registered number 8727263  and registered office address at 36 Egerton Road, Bournemouth BH8 9AY (“Healthily”), acting as controller in regard to your data.

Purpose of the Test

​

The purpose of the Test is to gather your feedback on the test version of the “Gen AI” Medical Chatbot (the “ChatBot”), and to collect and analyse information about your interaction with the Chatbot, and use this information to develop and improve the Chatbot (altogether referred to as “Testing Purpose”).

You will be able to access the Chatbot through the Attest platform (a third-party consumer research platform) that Halthily will use to facilitate the testing (the “Attest Platform”).

Participation in the Test

​

Participation in Test is available to the Attest Audience. There is no entry criterion for participating in the Test, however, Healthily will aim to achieve overall demographic splits by following general population splits across age, gender, household income, ethnicity, and location. The Test will be divided into two stages: (1) testing the Chatbot, and (2) completing the Survey. By participating in the Test, you agree to these Terms and Conditions (the “Terms”). “Gen AI” Medical Chatbot

​

Usage terms. “Gen AI” Medical ChatBot is a medical chatbot that leverages generative AI to create answers to your questions. It uses a large language model (LLM) provided by GPT-4o mini from OpenAI (a third-party LLM provider). The ChatBot uses information from Healthily medically reviewed health articles, available within the Health Library database, to provide answers to your questions. The ChatBot is a testing version, meaning that the information provided is not checked for medical safety, therefore, you should not rely on information received from the Chatbot. Any information provided by the Chatbot (including links to sources) is for Testing Purpose only and does not constitute real-life medical advice, triage, diagnosis, or treatment recommendations. You should consult with your doctor if you are concerned about your health, or call emergency services if there is an emergency.

Healthily provides the ChatBot for Testing Purpose only. You agree not to use the ChatBot for any personal, commercial or business purposes, or any other purpose outside of the Testing Purpose.

 

Survey

After finishing interacting with the ChatBot, you will be directed to a survey within Attest Platform, where you will be asked several questions about your experience, expectations, and shortcomings of the ChatBot (all together referred to as “Feedback”). Healthily will use your Feedback to create aggregated reports that, together with Analytics data, will be used for the development and improvement of the ChatBot.

Limitation of liability

 

The ChatBot is provided "AS IS" and without any warranties, meaning it might not be stable, perform as expected, or be free from bugs. Healthily liability for any damages that may arise from the use or misuse of the ChatBot is excluded, except to the extent required by applicable law, but only to the minimum extent possible. Nothing in these Terms shall be construed as providing any additional warranty or extending your rights beyond those provided by law. In addition, Healthily will not be liable for: (a) your actions or omissions in relation to information obtained through ChatBot, and any use of the ChatBot other than for Testing Purpose; (b) non-performance or improper performance of the ChatBot, in particular due to your hardware or software being defective or not meeting the criteria expressed in these Terms; (c) the accuracy, authenticity, reliability, correctness, and completeness of the information provided during the conversation with the ChatBot; (d) damage caused by the actions of third parties for which we are not responsible; (e) interruptions in the functioning of the ChatBot for any reason; and (f) any damage resulting from the use of the ChatBot in a manner contrary to the law or the Terms.

Security

 

We do not guarantee that the ChatBot will be secure or free from bugs or viruses. You should use your own virus protection software. You must not misuse the ChatBot by knowingly introducing viruses or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the ChatBot, the server on which the Chatbot is stored, or any server, computer or database connected to the ChatBot. You must not attack the ChatBot via a denial-of-service attack or a distributed denial-of-service attack.

 

Prohibited actions

 

Any posting or distribution of unlawful content through the ChatBot is prohibited. In particular, you are not allowed to post, insert, or enter any content that: (a) violates the personal rights and interests of third parties or incite hatred based on race, ethnicity, religion, culture, or sexual orientation; (b) promotes pornography and violence; (c) which are advertisements; (d) that violate rules widely accepted by the Internet community; (e) other listed in the OpenAI Usage Policy of https://openai.com/policies/usage-policies/.

 

Licence

The ChatBot and all graphics, technical solutions, software and databases and any other content posted and published in the ChatBot, including text, images, trademarks, trade names and logos, are either owned by Healthily or licensed for use in the ChatBot by third parties. Healthily is the owner or the licensee of all intellectual property rights in the Chatbot.

 

Those works are protected by copyright and other worldwide intellectual property rights laws. All such rights are reserved. 

 

Healthily grants you a non-exclusive, revocable, royalty-free, non-transferable, non-assignable, time-limited license to use the Chatbot for the Testing Purpose and in accordance with these Terms. You are not granted any other rights, including intellectual property rights, other than those set forth in these Terms, and in particular, you are not granted any right to use the Chatbot source code. You acknowledge that a breach of the above obligation may result in an infringement of Healthily intellectual property rights and may give rise to legal liability.

 

You must use the ChatBot in a manner that does not interfere with the proper functioning of the ChatBot or the Test. In particular, you may not, on your own and/or with the help of any third party, (i) modify, (ii) bypass or defeat the security systems of the ChatBot, (iii) take any action that affects the ChatBot in a way that may damage and/or overburden the ChatBot, (iv) copy, (v) modify, (vi) scrape, (vii) publish, (viii) reproduce the ChatBot in whole or in part, or take any action that is not supported by the limited license granted to you.

 

Governing Law

 

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of England. You and Healthily agree to the exclusive jurisdiction of the courts of England in respect of any disputes which may arise in relation to the Test.
