Please read these Terms of Service together with our Privacy Policy (collectively the “Terms”) carefully so that you understand them before you start using our Services (as defined below) and to learn how and what data we collect and how we use it. These Terms apply to all the Services we provide to you through the testing environment and when you interact with our Healthily website (“Site”). These Terms contain details of each of our Services, the use and limits of our Services and of our liability to you and your and our rights and obligations in relation to the provision and use of the Services.
Above all, it is important that you are aware that our Services are provided for demonstration and testing purposes only (altogether referred to as “Testing”), and do not constitute professional medical advice, diagnosis or treatment. Our Services are not a substitute for professional medical advice, diagnosis, therapy or treatment. If you think you may have a medical emergency, call your doctor or the emergency services immediately.
Do not enter any personally identifiable information (such as your email address, full name, or other identifying details) when interacting with Dot.
If you do not agree to these Terms, you should not use our Services and/or our Site. If there is anything that you do not understand, please contact us at privacy@healthily.ai.
WHO WE ARE
Healthily Ltd, incorporated and registered in the UK with the company number 08727263, whose registered office is at 36 Egerton Road, Bournemouth, BH8 9AY, UK, represented by Jonathon Carr-Brown, provides Healthily Services (hereinafter collectively referred to as: ‘Healthily’, ‘we’ or ‘us’).
HEALTHILY SERVICES
Our services include DotTM - Dot-Health Navigation Platform, AI Medical Assessment, and Medically Validated Content (cumulatively referred to as our ''Services'' or individually as a ''Service'') and Healthily website (“Site”).
GRANT OF ACCESS
To test our Services, you will need to access one of these testing environments:
1. Storybook-based preview environment hosted on a Healthily URL provided to you by Healthily.
2. A testing app, which may be accessible via (a) a hosted web link, (b) the healthily.ai website, and/or (c) a downloadable mobile application.
Some testing environments will require valid username and password credentials issued by Healthily. Access credentials are provided exclusively to you and may not be shared, transferred, or disclosed to any third party.
USER EXPERIENCE FOR TESTING PURPOSES EXPLAINED
Before you start testing Dot, you will need to confirm these terms and accept the data processing practices and our privacy policy.
AI MEDICAL ASSESSMENT (“Dot”)
Dot will guide you through a questionnaire and ask you for your age and gender, as well as a series of questions about your symptoms and health. It will then use this data to compare it with the data of individuals of the same age and gender who are normally healthy and do not suffer from any serious, long-term condition to calculate the probabilities of possible causes for your symptoms. Dot will then show the ''Suggested next step'' based on a number of factors, such as the highest probability of a possible cause for your symptoms, the specific symptoms you select and your health factors. You will be able to read the reasons behind the decision within ''Why this recommendation. Please read the explanation as Dot is not a real-life doctor and can make mistakes.
Suggested next steps
Dot will recommend the next steps, showing the level of care and the type of care. Levels of care: self-care at home or in pharmacy (for non-serious health issues that can be solved with self-care), routine (a routine check-up is needed), urgent in person or via telemedicine (visiting a health professional is recommended), emergency (indicates the possibility of a serious underlying condition that requires going to the emergency department), ambulance (indicates a possibility of a serious underlining condition that requires calling an ambulance). Depending on the type of care that is most likely needed, Dot will provide recommendations, for example: visit the NHS general practice, call a digital practice, visit a pharmacy etc. You can save the page as a PDF if you open the print dialogue box, and you will be able to view your report at the time of the conversation with Dot.
After you close the window, you will no longer be able to access the report.

Within this section, you will find information about what Dot has considered to generate the recommended outcome. If applicable, you will find any possible causes that need to be ruled out due to certain symptoms selected and/or health factors.

You will find the most likely cause(s) of the symptoms within this section and other less likely possible causes. Each possible cause includes a level of care appropriate to that condition or problem area. Each problem area tile is clickable, providing an article on the possible cause, which includes an explanation of the associated conditions, how they can be diagnosed, and information on when to worry. Don’t hesitate to explore the less likely options if you think that this is the right next step for you.
By clicking a specific condition, you will be able to learn about this condition, its symptoms, treatment and how it is diagnosed.
Your other options
In this section, you will find information about other care options that you might consider.
While Dot strives to give you the best possible information, it cannot consider all factors that your doctor can, such as medical and family history, physical examination, tests, etc. The medical conditions it calculates based on what you report are merely possible conditions, and they do not mean that you have any of these conditions or that you do not have any other worrying conditions, which it did not manage to calculate due to the limited information it uses. You should never rely on or make health or well-being decisions based on information provided by our Services without first consulting a doctor or other appropriate health professional. Our liability in relation to your use of the AI Medical Assessment is as set out in the section on Our Liability and Disclaimer of Warranties below.
Feedback
Any feedback, suggestions, or findings (the “Feedback”) you provide to us in connection with the Testing will be used by us freely and without restriction to improve or develop our Services. You assign to us all rights in such Feedback, and we shall have no obligation to keep such Feedback confidential or to compensate you for it.
MEDICALLY VALIDATED CONTENT
Medically Validated Content consists of medical articles either sourced directly from the UK’s NHS or content created and verified by our team of doctors following rigorous review and adherence to safety procedures.
WEBSITE
Through our website (“Site”) you can find useful information about Healthily, how to use our Services, which services we provide, how to get in touch with us, what the CE mark is, etc., and find the latest version of Privacy Policy, Terms of Service, Cookie Policy and other legal documents. Your use of the Site is governed by these Terms.

What Dot recommends is not a diagnosis, medical advice or a definitive next step. Dot isn't a real-life doctor, which means it can't: consider all the information a doctor can when interacting with you; identify every possible condition or symptom you may have; always understand the information you give it. It gives recommendations on what you can do next, but you should only act on these if you think it’s appropriate for you to do so. Always visit a doctor if you’re unsure, or if your symptoms get worse, or don’t improve. If it's serious or you think it's an emergency, don't delay – seek medical attention right away.
Dot can't be used to get information about babies, children under the age of 18, pregnant women, people who are immunosuppressed or on immunosuppressive treatment, people with complex or long-term conditions or medical professionals. It also can’t be used for various conditions that are available here How to use Healthily safely.
support@healthily.ai, privacy@healthily.ai emails are not intended for inquiries about your health, medical problems or medical questions. You can send us any other questions about our Services including your comments and suggestions for improvements. If we receive an email that includes questions about your health, medical problems and/or conditions/symptoms, you will receive a standard auto-reply informing you that we do not provide this type of information via email and that you should always consult a medical professional in such cases.
YOUR OBLIGATIONS
By accessing or using our Site and/or Services you hereby confirm and agree that: a) you have read and understood these Terms in full; b) that you are at least 18 years and legally able to enter into a binding contract; c) that you are responsible for maintaining the confidentiality of your password and any other security information related to your access account; d) that you will notify us immediately about any unauthorised access or suspected security breach; e) that except to the extent as expressly permitted herein, your use of our Services is for Testing purpose only, all in accordance with these Terms; f) that you are solely and fully liable and responsible for any activities or omissions that are made by or due to using our Services; g) that we will hold you liable and responsible for any damage or loss incurred as a result of the use of your account by any person whether authorised by you or not, and you agree to indemnify us for any such damage or loss; h) that you will comply with local laws and health and safety requirements when using our Services.
LICENCE TO ACCESS AND USE THE SITE
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our Site for its intended purpose, including browsing content, and accessing the Testing Services made available through it. This licence is provided to you personally and may not be assigned, transferred, sold, or sublicensed. No other rights are granted in respect of the Site except as expressly stated in these Terms.
LICENCE AND SCOPE OF ACCESS FOR TESTING PURPOSES
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our Services solely for internal evaluation and testing purposes ("Testing Purposes"). This licence is provided to you and may not be assigned, transferred, sold, or sublicensed. No other rights are granted except as expressly stated in these Terms.
Permitted Use. During the Testing period, you may: (a) evaluate functionality, features, and performance; (b) provide feedback; (c) demonstrate the Services to authorised personnel involved in evaluation.
Restrictions. During the Testing period, you must not: (a) use the Services for clinical, diagnostic, treatment purposes, or any other medical decision-making purposes; (b) make the Services available to patients, end users, or any third parties outside of your authorised internal evaluation team; (c) input, upload, or process any real patient data or any data that identifies or could identify an individual; (d) use the Services in any production, live, or commercial environment or otherwise exploit the Services or their outputs for commercial purposes; (e) copy, reproduce, distribute, resell, sublicense, or otherwise make available the Services or any outputs derived from them, except as permitted under these Terms; (f) reverse engineer, decompile, access source code, or attempt to extract underlying models, systems or no-public compomnents of the Services ; (g) interfere with, disrupt, disable or compromise the security, integrity or performance of the Services or any related systems, including by circumventing security features or introducing viruses, malware, or other harmful code; (h) use or access the Services after suspension or termination of access or engage in any unlawful or illegal activity in connection with the Services; (i) misuse the Service by knowingly introducing viruses, Trojans, worms, logic bombs or other material which would harm the Service or any user of the Service's own equipment; (j) collect, scrape, or extract data from the Service other than in accordance with these Terms of Service.
INTELLECTUAL PROPERTY
All rights, title, and interest in the Site and the Services, including software, content, branding, trademarks, and underlying technology, are owned by us or our licensors. Except for the limited testing licence granted above, you acquire no rights in or to the Services or any related intellectual property. Other than as allowed in these Terms, you are not given a right to use the "Your.MD", "DOT", "Mediterm", "AIMed", "Find your health", "Healthily" and "Live Healthily" names or any of the "Healthily " names, trademarks, logos, domain names and other distinctive brand features. You agree that all confidential information, copyright and other intellectual property rights in our Services or any portion of the Services belong to us or the people who have licenced us to use those rights. You agree that you have no rights in or to our Services or any portion of the Services other than the right to use them in accordance with these Terms.
The materials and content comprising the Service belong to us or the people who have licensed them to us and we give you permission to use these materials and content for the sole purpose of using the Service in accordance with these Terms.
UPDATES, AVAILABILITY, AND CHANGES
We may modify, update, suspend, or discontinue any part of our Site and the Services at any time. This may include changes that affect functionality, reset features, or remove previously available elements. We are not liable for any resulting impact on your use of the Services.
We make our Services and our Site available for access using internet infrastructure, but are not responsible for the infrastructure ourselves. If you wish to use our Services, you should ensure that you have an internet-enabled device and a sufficient internet connection available. We are not liable for connection and/or technical errors such as hyperlinks not working etc.
BREACH AND ENFORECEMENT
Failure to comply with any of the requirements of these Terms constitutes a serious breach and may result in our taking all or any of the following actions (with or without notice): (a) immediate, temporary or permanent withdrawal of your right to use our Service; (b) issuing a warning to you; (c) legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; (d) disclosure of such information to law enforcement authorities as we reasonably feel is necessary. These actions are not limited, and we may take any other action we reasonably deem appropriate.
THIRD PARTY PROVIDERS
We cannot provide all services necessary for the successful operation of our Services by ourselves. We therefore use various providers for the purposes of offering the Services to you and improving your user experience.
When you use our Services in combination with other services, you also consent to such third party’s terms of service, so please read their terms of service carefully before you start using our Services.
DATA STORAGE
We store all your data in the US using AWS Services and the Google Cloud Platform. For more information about our data storage, please read our Privacy Policy.
ANALYTICS
We use third party providers or create a custom SDK to perform analytics on our Site and Dot. We currently do not use third party providers to perform analytics, and we do not perform analytics on our website. To find out what data we collect with analytics and why we use this data, please read our Privacy Policy.
OUR LIABILITY AND DISCLAIMER OF WARRANTIES
DISCLAIMER OF WARRANTIES
The Site and the Services provided for testing purposes only are made available on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted use, and error-free operation.
You acknowledge that any reliance on information provided through the Site and Services is at your sole risk. The Site, the Services, including any outputs or assessment results, are not intended to be, and must not be used as, a substitute for professional medical advice, diagnosis, or treatment. Always seek advice from a qualified healthcare professional. In case of a medical emergency, contact emergency services immediately.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of profits, revenue, data, goodwill, or business interruption, arising out of or related to your use of the Site or Services, including reliance on any information provided.
Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under applicable law.
Our total aggregate liability for all claims arising out of or in connection with the Site and/or the Services shall not exceed the amount (if any) paid by you for access to the Services.
Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the above may not apply to you.
We are not responsible for any third-party services, technologies, or integrations you may access in connection with the Services, and no agency, partnership, or joint venture relationship is created.
INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Healthily, its employees, contractors, officers, and directors from any and all claims, suits, damages, costs, lawsuits, fines, penalties, liabilities, expenses (including attorney fees) that arise from (a) your use or misuse of our Services, (b) violation of these Terms, (c) your violation of applicable laws or regulations; or (d)violation of any rights of a third party.
Healthily reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defences.
You agree that a breach of these Terms will cause irreparable harm to Healthily for which monetary damages would not be an adequate remedy, and Healthily shall be entitled to seek equitable relief in addition to any remedies it may have hereunder, or at law without a bond, other security, or proof of damages.
ENDING OUR RELATIONSHIP
If at any time, you do not feel that you can agree to these Terms or any changes made to the Terms, you must immediately stop using the Service. If you wish to end your use of the Service, please deactivate your account by deleting our Services.
We may immediately end your use of the Services if you breach these Terms or applicable legislation. We may also withdraw the Service at any time, if we give you reasonable notice that we plan to do this.
If you or we end your use of the Services, or we withdraw the Service as described in this section, we may delete any information we hold about you. You will also lose any rights you have to use the Service or access our content. We will not offer you compensation for any losses.
FINAL PROVISIONS
These Terms, incorporating Privacy Policy, constitute the entire agreement between you and Healthily with respect to the Services and/or Site, and they supersede all prior or contemporaneous understandings regarding such subject matter. No amendment to, or modification of, these Terms will be binding unless agreed in writing by Healthily. Healthily may amend these Terms as described below. No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder preclude further exercise of any other right hereunder.
We will occasionally update these Terms as necessary to protect our users, furnish current information and respond to legal and technical changes. Because we are constantly adding new services and features, we might not make an immediate upgrade to the Terms, except in the case of material changes to our practices. The most current version of the Terms will govern your use of our Services, and we encourage you to periodically review them. It is available within the "Legal'' section on our Site as well in the footer of AI Medical Assessment. You will be informed about the material changes to these Terms, fourteen (14) days before they become applicable. Your continued usage of the Services after the changes become applicable constitutes your acceptance of the changes.
You agree that Healthily has no obligation to provide any updates or to continue to provide or enable any particular features, functionality, tools or content, and will not be liable with respect to any such modifications, discontinuance or deletions.
If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision shall be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms shall continue in full force and effect.
The original version of these Terms is written in English. Any translation into any other language is done for local requirements and in the event of a dispute, inconsistency or discrepancy between English and any non-English versions, the English version shall govern, to the extent not prohibited by local law in your jurisdiction.
These Terms, and any non-contractual obligations, and all disputes or controversies arising out of or relating to these Terms shall be governed by, and construed in accordance with, the laws of England and Wales, excluding its conflict of laws rules. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms, save that nothing in this clause shall limit any mandatory consumer protection rights you may have under the law of your country of residence.
