HEALTHILY ASSESSMENT TOOL TERMS AND CONDITIONS

1. WHO WE ARE AND WHAT WE DO

We’re Healthily and have created an assessment tool to empower you with information and help you decide on your best next step. THE ASSESSMENT TOOL IS A SOFTWARE CHATBOT. IT DOES NOT DIAGNOSE HEALTH CONDITIONS, PRESCRIBE HOW YOU SHOULD TREAT ANY HEALTH CONDITION YOU MAY HAVE OR TELL HOW YOU NEED TO PROCEED.


Healthily assessment tool (‘’Healthily Services’’, ‘’Assessment Tool’’, ‘’Tool’’, ‘’our Services’’), offered by Healthily Ltd. incorporated and registered in UK with company number 08727263 whose registered office is at 36 Egerton Road, Bournemouth, England, BH8 (''Healthily'', ''we'', ''us'') is embedded to third party services (''Partner/s'', ''Partner Services'') and enables you to:

  • Do an assessment of your symptoms and receive next steps to help you decide on how to proceed

  • File, update and manage claims on the Partner Services

  • Check the third party’s policy information to see what's covered


These terms and conditions along with the Privacy Policy (collectively, the ''Terms'') govern your use of the Healthily Services embedded to Partner Services and your relationship with us. Before using the tool, we will ask you to actively accept these terms and our privacy policy. You must be at least 18 years or older and capable in your country of residence of entering into a legal binding agreement to use the tool in your country of residence. It is important that you read and understand in full the Terms (including the section entitled Our Liability and Disclaimer of Warranties below) before you start using our tool. If there is anything that you do not understand, please contact us at privacy@healthily.ai. If you do not agree to these terms, our data processing practices or you are not older than 18, you should not use the tool.

GET HELP WITH YOUR SYMPTOMS

Find next steps for your symptoms

Our Assessment Tool will ask you for your age and gender as well as a series of questions about your symptoms and health. It will then use this data to compare it with the data of individuals of the same age and gender who are normally healthy and do not suffer from any serious, long-term condition to calculate the probabilities of possible causes for your symptoms. The tool will then show ''Recommend the next step'' based on a number of factors, such as the highest probability of a possible cause for your symptoms, the specific symptoms you select and your health factors. You will be able to read the reasons behind the decision by clicking on the ''Your outcome explained''. Please read the explanation as the tool is not a real-life doctor and can make mistakes. 


Recommended next steps

We will recommend the next steps showing the level of care and the type of care. Levels of care: self-care at home or in pharmacy (for non-serious health issues that can be solved with self-care), routine (a routine check-up is needed), urgent in person or via telemedicine (visiting a health professional is recommended), emergency (indicates the possibility of a serious underlying condition that requires going to the emergency department), ambulance (indicates a possibility of a serious underlining condition that requires calling an ambulance). Depending on the type of care that is most likely needed, we will provide recommendations, for example: visit the NHS general practice, call the Aviva digital practice, visit a pharmacy etc. You can save the page as a PDF if you open the print dialog box and you will be able to view your report at the time of conversation with our tool, but not later, as we do not store any data that could personally identify you.  


Your Outcome explained

Click on this option to see what the tool considered to generate the recommended outcome. If applicable, you will find any possible causes that need to be ruled out due to certain symptoms selected and/or health factors. Next you will find the most likely cause(s) of the symptoms. Finally, you will find other less likely possible causes. Each possible cause includes a level of care appropriate to that condition or problem area. Each problem area tile is clickable providing an article of the possible cause which includes an explanation of the associated conditions, how they can be diagnosed, and information on when to worry. Don’t hesitate to explore the less likely options if you think that this is the right next step for you.  


Medically verified content

Visit our medical library in ''Medically verified information'' to learn about various conditions, its symptoms, treatment and how these are diagnosed.  


Options if you have a referral

You have a referral if you have already spoken with a medical professional and know what are your next steps. In such a case, you can find out how to ‘’Start a claim'' via our tool. If you don't have a referral, our tool will give you the option to identify possible next steps, check policy information, explain how to make a claim or show medically verified content. Starting a claim will redirect you to our Partner Services.

Services available via self-referral

Our tool also offers some other services that you might find interesting, for example ''Gender Identity support'', ''Neurodiversity support'', ''Back to Better'', ''Mental health pathway'' etc.


MAKE A NEW CLAIM & UPDATE EXISTING CLAIM

New claims guidance

Choose this option if you want to make a new claim. Starting a claim will redirect you to our Partner Services. If you already have a referral, our tool will provide you with the option to start a claim directly. If you don't have a referral yet, you will have these options to choose from, ''Finding the next steps for your symptoms'', which will enable you to decide on how to proceed, ''Check medically verified content'' to learn more about your symptoms, learn ''How to make a claim'' or ''Check policy information'' to see what's covered.


Existing claims guidance

When choosing ''Find out how to update an existing claim'' you can use ''Call the Aviva claims team helpline '' and you will be transferred to MyAviva chat or you can use Aviva's claims helpline by choosing ''Call our claims helpline'', open daily from 9 am to 5 pm. Update existing claim will redirect you to our Partner Services.


CHECK POLICY INFORMATION

You can check your policy information with Partner Services by clicking on ''Check policy information'' and you will be redirected to such Partner Services. 


MANAGE YOUR HEALTHCARE POLICY

You can manage your account by clicking on this section. You will be able to review your data and read legal documents. The data are coming from our Partner who embedded the Assessment Tool to its services, so any questions related to the data or managing your account should be addressed with such Partner.


FEEDBACK

When submitting Service feedback, comments and suggestions for improvements via the Healthily Assessment Tool (''Review''), by sending us an email to feedback@healthily.ai or posting a public Review on a third party site, you hereby grant us the worldwide, non-exclusive, perpetual, royalty-free licence under any and all intellectual property right that you own or control, to use, copy, publish, display, reproduce, translate, modify, and/or commercially exploit your review, together with your name, on our tool, social media or any other platform that we use to promote our Services. We will never edit a review in such a way as to create a misleading impression of your views. You may terminate this licence by sending us an email to: privacy@healthily.ai, subject: Termination Review Licence.


3. USE OF THE TOOL

Our Tool will provide information based on probable causes for users with your reported symptoms but is not perfect. The recommended next steps and other options are for information purposes only and are not intended to replace a consultation with a qualified health professional.

What the tool recommends is not a diagnosis, a medical advice or a definitive next step. The tool isn't a real-life doctor, which means it can't: consider all the information a doctor can when interacting with you; identify every possible condition or symptom you may have; always understand the information you give it. It gives recommendations on what you can do next, but you should only act on these if you think it’s appropriate for you to do so. Always visit a doctor if you’re unsure, or if your symptoms get worse, or don’t improve. If it's serious or you think it's an emergency, don't delay – seek medical attention right away.


Our tool can't be used to get information about babies, children under the age of 18, pregnant women, people who are immunosuppressed or on immunosuppressive treatment, people with complex or long-term conditions or medical professionals. It also can’t be used for various conditions that are available here: ‘’How to use Healthily safely’.


While “Find your next step” is Healthily’s service, other parts of the tool (make a new claim, update a claim, manage your account, recommended services) are integrated to third parties services that you are already using and are intended to help you easily navigate through those services. Should you have any concerns or questions about those third-party services, you should contact such third parties directly.


4. YOUR OBLIGATIONS

Healthily Services should be used as instructed by Healthily. 

Your right to use the Healthily Assessment Tool is personal to you and you are not allowed to transfer this right to another person. As part of Healthily Services, we allow you to use our tool as integrated to Partner Services for the sole purpose of accessing and using the tool in accordance with these Terms and we grant you a non-exclusive, personal, non-transferable licence for this sole purpose. The materials and content comprising the Service belong to us or the people who have licensed them to us and we give you permission to use these materials and content for the sole purpose of using the Healthily Service in accordance with these Terms.


You hereby confirm and agree: a) that you have read and understood these Terms in full; b) that you will use our tool in accordance with these terms; c) that you are at least 18 years of age; d) that you are legally able to enter into a contract; e) that all the information that you provided in or through our Tool is accurate, true, current and complete; f) that you are solely and fully liable and responsible for any activities or omissions that are made by or due to using our Tool; g) that we will hold you liable and responsible for any damage or loss incurred as a result of the use of our Tool by any person whether authorised by you or not, and you agree to indemnify us for any such damage or loss; h) that you will not to violate any applicable local, state, national or international law, statute, ordinance, rule, regulation or ethical code in relation to your use of the tool and your relationship with us; i) that you will comply with local laws and health and safety requirements when using our tool.


Failure to comply with any of the requirements of these Terms constitutes a serious breach and may result in our taking all or any of the following actions (with or without notice): (a) immediate, temporary or permanent withdrawal of your right to use our Tool ; (b) issuing a warning to you; (c) legal action against you including proceedings for reimbursement of all costs (including, but not limited to, reasonable administrative and legal costs) resulting from the breach; (d) disclosure of such information to law enforcement authorities as we reasonably feel is necessary. These actions are not limited, and we may take any other action we reasonably deem appropriate.


You agree, confirm, and acknowledge that the information provided by our Tool, will always be based on the information that you have provided to us. It is your responsibility to ensure this information is correct and complete, and you accept that any failure to do so (whether intentionally or not) may affect the information we can give to you and may have consequences for which we are not responsible.


We are constantly updating and improving the Services to try and find ways to provide you with new and innovative features and services. Improvements and updates are also made to reflect changing technologies, tastes, behaviours, and the way people use the Internet and our Services. To do this, we may need to update, reset, stop offering and/or supporting a particular part of the Healthily Services, or feature relating to the Services.


We make the tool available for access using Partner Services but are not responsible for the infrastructure or such Partner Services. If you wish to use our Healthily Services, you should ensure that you have an internet-enabled device and a sufficient internet connection available as well as the right to use Partner Services that integrate with our Tool. We are not liable for connection and/or technical errors such as hyperlinks not working etc. neither for third party restricting your access to their service and consequently our Tool.


5. IP RIGHTS

You can use Healthily Services in accordance with the licence, but do not acquire any other intellectual property rights.

Other than as allowed in these Terms you are not given a right to use the "Healthily", "DOT", "Mediterm", "AIMed", "Find your health", "Healthily" and "Live Healthily" names or any of the "Healthily/Your.MD" names, trademarks, logos, domain names and other distinctive brand features. You agree that all confidential information, copyright and other intellectual property rights in Healthily Services or any portion of Healthily Services belong to us or the people who have licenced us to use those rights. You agree that you have no rights in or to Healthily Services or any portion of the Healthily Services other than the right to use them in accordance with these Terms.


6. PARTNER SERVICES/THIRD PARTY SERVICES/CONTENT

You will use Healthily Services via Partner Services, and you may be directed to third party services/content. Please bear in mind that we are not responsible for such services.  

We cannot provide all services necessary for the successful operation of Healthily Services by ourselves. We therefore use various providers for the purposes of offering the Healthily Services to you and improving your user experience. We also offer access to third party content, namely products or services which are offered or provided by third parties and/or links to such content within Healthily Services. When you use Healthily Services in combination with other services, you also consent to such third party’s terms of service and privacy policy, so please read their terms of service carefully before you start using Healthily Services.


Healthily and third-party providers offering a platform through which you access Healthily Services are independent contractors and each of us is solely responsible for the operation of their own services, namely Healthily for Healthily Service and third-party provider for your data, managing claims, Information about their policies, telemedicine service, chat option etc. Each of us will be solely responsible for any end user request made via such services. Third Parties are solely responsible for collecting and using any data you may give them, and they use it to provide their services via Healthily Services.


We are in no way responsible for the actions of these third parties, the content of their sites, their products or services, the use of the information you provide to them, or any of the products or services they may offer and no agency relationship exists between us and the third parties.

7. TERM AND TERMINATION

You can stop using the Healthily Services at any time and as so can we.

You can start using the Healthily Services by accessing it through Partner Services and accepting these Terms. Such third-party platform providers may terminate or suspend your account or terminate Healthily Services on their platform at any time and this will consequently terminate your agreement with Healthily. You can stop using the Healthily Services at any time, including if you do not agree with the changes to the Healthily Services or these Terms. Healthily may terminate or suspend Healthily services without prior notice. 


8. OUR LIABILITY AND DISCLAIMER OF WARRANTIES

We aim at empowering you with the information to help you decide your next steps but cannot guarantee that our Services will meet your health or medical requirements.  You are ultimately responsible for your decisions regarding the information we provide.


You hereby agree, confirm, and acknowledge that our tool, Services and any information provided to you via our Services, whether written, stated or implied, especially including possible next steps, recommended services and medical conditions in the Assessment report are for information purposes only. Any reference to a third-party product or services via our tool is likewise for information purposes only. Our tool and information therein are provided ''AS IS'' with all fault and without warranty of any kind, therefore you will have no claim and demand against us.


The tool is a chatbot and not a real doctor. It is good at identifying less serious conditions that can improve with your simple actions and understanding (even if the symptoms you report suggest seeing a doctor) provided that you’re normally healthy and don’t have any chronic, complex or rare conditions. It can also provide useful information about specific conditions to help you decide on the next steps. Although it has information about many health problems, it is not perfect and can’t consider all the information your doctor can. It is an adaptive learner, but it is not able to identify all conditions or symptoms and might not understand complex sentences.


THE ASSESSMENT TOOL IS A SOFTWARE CHATBOT. IT DOES NOT DIAGNOSE HEALTH CONDITIONS, PRESCRIBE HOW YOU SHOULD TREAT ANY HEALTH CONDITION YOU MAY HAVE OR TELL HOW YOU NEED TO PROCEED. OUR SERVICES ARE PROVIDED FOR INFORMATION PURPOSES ONLY. YOU AGREE, CONFIRM AND ACKNOWLEDGE THAT OUR SERVICES DO NOT CONSTITUTE A DOCTOR PATIENT RELATIONSHIP AND ARE NOT A SUBSTITUTE FOR YOUR REGULAR DOCTOR, GP, DIAGNOSIS, A FACE-TO-FACE EXAMINATION, SESSION BY A LICENSED QUALIFIED PROFESSIONAL OR RECOMMENDATION TO USE THIRD PARTY SERVICES PROVIDED IN THE NEXT STEP RECOMMENDATION.


You should never rely on or make health or well-being decisions based on information provided by our tool without first consulting a doctor or other appropriate health professionals. You agree, confirm, and acknowledge that although our tool may provide useful information, we cannot assess whether the use of the Tool is right and suitable for your needs. You are ultimately responsible for deciding whether to contact a health professional and/or seek medical advice about any health concerns that you have shared via the tool.


Reliance on any information provided via our Assessment Tool is solely at your own risk. We do not make, and hereby disclaim, any and all express, implied or statutory warranties, including implied warranties of condition, uninterrupted use, merchantability, satisfactory quality, fitness for a particular purpose, non-infringement of third-party rights, and warranties (if any) arising from a course of dealing, usage, or trade practice. The use of Healthily Services is at your sole risk.

Some jurisdictions do not allow the exclusion of, or limitations on, implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you.


To the fullest extent permissible by applicable law, your sole and exclusive remedy for dissatisfaction with our Services is to stop using the Services and, in no event shall Healthily, its subsidiaries or its affiliates be liable to you: a) for death or injury: b) any damages that are not foreseeable or, even if foreseeable, not directly related to our breach of these Terms or our negligence: c) any personal injury, damage, lost profits, lost revenues, cost of substitute services, loss of data, loss of goodwill, work stoppage, computer failure or malfunction: d) any other form of direct or indirect, special, incidental, consequential or punitive damages from any causes of action arising out of or related to Healthily Services, including any information provided to you or lack of those in connection with the Services: or e) any action or inaction by you resulting from the information we have or have failed to provide to you, whether arising in tort (including negligence), contract, strict liability or otherwise and whether or not Healthily has been advised of the possibility of such damage. In no event will we be liable to you resulting from your interaction with any third party/Partner or third-party/Partner technology in connection with our Tool.


Some jurisdictions do not allow a limitation of liability for death, personal injury, fraudulent misrepresentations or certain intentional or negligent acts, or violation of specific statutes, or the limitation of incidental or consequential damages, so some or all of the above limitations of liability may not apply to you. Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by laws of England and Wales.


In addition, in no event will we be liable to you for anything resulting from your interaction with any third party/Partner or third party/Partner technology in connection with Healthily Services and no agency relationship exists between us and any such third party or Partner.


To the maximum extent permitted by applicable law, in no event shall Healthily be liable for any special, incidental, indirect, or consequential damages whatsoever. Subject to this section, Healthily’s total liability for all losses you suffer arising from, or in connection with, the use of the Healthily Services shall be no greater than the amount paid by you for the use of our Services.


9. FINAL PROVISIONS

We value hearing from our users and are always interested in learning about ways to improve our Services. You are always welcome to send us any comments or questions to: feedback@healthily.ai.

The most recent version of these Terms and Privacy Policy constitutes the entire agreement between you and Healthily with respect to the Healthily Services, and such documents supersede all prior or contemporaneous understandings regarding the subject matter described herein.

We will occasionally update these Terms as necessary, to protect our users, furnish current information and respond to legal and technical changes. Because we are constantly adding new services and features, we might not make an immediate upgrade to the Terms, except in the case of material changes to our practices. The most current version of the Terms available on the “Home” screen’ part of the Healthily Services or our website (https://www.livehealthily.com) will govern your use of our Services and we encourage you to periodically review it. Your continued usage of the Healthily Services after the updates become applicable constitutes your acceptance of the changes.


You agree that Healthily has no obligation to provide any updates or to continue to provide or enable any particular features, functionality, tools or content, and will not be liable with respect to any such modifications, discontinuance or deletions.


No failure to exercise, and no delay in exercising, on the part of either party, any right or any power hereunder preclude further exercise of any other right hereunder.


If any provision of these Terms is illegal or unenforceable under applicable law, the remainder of the provision shall be amended to achieve as closely as possible the effect of the original term and all other provisions of these Terms shall continue in full force and effect.


The original version of these Terms is written in English. Any translation into any other language is done for local requirements and in the event of a dispute, inconsistency or discrepancy between English and any non-English versions, the English version shall govern, to the extent not prohibited by local law in your jurisdiction.


These Terms, and any non-contractual obligations, and all disputes or controversies arising out of or relating to these terms shall be governed by, and construed in accordance with, laws of England and Wales, excluding its conflict of laws rules.
